Terms of service

Please read these terms carefully before using Elgarde.

1. Agreement to terms

By accessing or using Elgarde ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These terms apply to all visitors, users, and paying customers. Additional terms may apply to specific paid plans, which will be presented at the time of purchase.

2. Service description

Elgarde is a regulatory intelligence and trust platform. The Service audits publicly accessible websites for cookie consent, accessibility, and privacy compliance, and produces structured reports citing applicable regulations.

The Service includes:

  • Free scan: an instant, limited compliance check of a single publicly accessible domain
  • Full report: a detailed compliance report with jurisdiction-specific findings and remediation guidance (one-time purchase)
  • Monitoring: continuous compliance monitoring with alerts and periodic re-scans (subscription)
  • Expert consultation: 1-on-1 compliance guidance sessions (purchased per hour)

3. Eligibility and accounts

The free scan does not require an account. Paid services require a valid email address and payment method.

You must be at least 18 years old or the age of majority in your jurisdiction to use paid services. By creating an account, you represent that the information you provide is accurate and complete.

You are responsible for maintaining the security of your account credentials and for all activity under your account.

4. Acceptable use

You agree not to:

  • Submit domains you do not own or are not authorized to scan
  • Use the Service to harass, threaten, or intimidate website owners with scan results
  • Attempt to circumvent rate limits, abuse prevention mechanisms, or access controls
  • Use automated tools to submit bulk scans without prior written agreement
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Resell, redistribute, or white-label scan results without written permission

We reserve the right to suspend or terminate access for violations of these terms.

5. Free scan

The free scan is provided as-is, without warranty. It produces a limited compliance summary and is intended to demonstrate the Service's capabilities.

Free scan results are retained for 90 days and may be accessed via a shareable link. We reserve the right to modify, limit, or discontinue the free scan at any time.

The free scan is rate-limited to prevent abuse. Repeated excessive use may result in temporary or permanent restrictions.

6. Paid services and billing

Paid services are billed as described on the pricing page at the time of purchase.

  • One-time purchases (full reports): charged once at the time of purchase. No recurring billing.
  • Subscriptions (monitoring): billed monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • Consultation sessions: billed per hour, charged at the time of booking.

All prices are in euros (EUR) and include applicable VAT where required. Payments are processed by Stripe. We do not store your payment card details.

7. Refunds

Full reports: if the scan fails to complete due to a technical error on our side, you are entitled to a full refund. Refund requests must be submitted within 14 days of purchase to hello@elgarde.com.

Monitoring subscriptions: you may cancel at any time. No refunds are issued for partial months. EU consumers have a 14-day right of withdrawal for online purchases, which applies before the first scan is delivered.

Consultations: sessions cancelled at least 24 hours in advance are fully refundable. No-shows are non-refundable.

8. Not legal advice

Elgarde provides compliance intelligence, not legal advice. Our reports cite applicable regulations and identify potential violations, but they are not a substitute for qualified legal counsel.

You are responsible for your own compliance decisions. We recommend consulting a lawyer familiar with the specific regulatory requirements of your jurisdiction before taking action based on our reports.

9. How we scan

Elgarde scans only publicly accessible pages. Our scanner:

  • Identifies itself with a clear User-Agent string including a contact URL
  • Respects robots.txt for the entry URL
  • Does not attempt to access authenticated areas
  • Limits request frequency (max 1 request per 5 seconds per domain)
  • Captures only the data necessary for the compliance report

10. Intellectual property

The Elgarde name, logo, and Service are the property of the operator (see imprint).

Your reports: you retain the right to use, share, and distribute reports generated for domains you own. You may share report links with third parties (e.g. your developer, legal counsel, or clients).

Our content: all other content on this website (text, design, code, documentation) is protected by copyright and may not be reproduced without permission.

11. Limitation of liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not guarantee that scan results are complete, accurate, or up to date. Compliance landscapes change, and automated tools have inherent limitations.
  • We are not liable for any fines, penalties, lawsuits, or regulatory actions resulting from your reliance on our reports.
  • Our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

Nothing in these terms excludes or limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

12. Service availability

We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

For monitoring subscribers: if the Service is unavailable for more than 72 consecutive hours due to an issue on our side, you may request a pro-rated credit for the affected period.

13. Termination

By you: you may stop using the Service at any time. To cancel a subscription, use your account settings or email hello@elgarde.com.

By us: we may suspend or terminate your access if you violate these terms or engage in behaviour that threatens the Service, its users, or third parties. We will provide reasonable notice except in urgent situations.

Upon termination, your right to access paid reports persists for 90 days. After that period, your data is deleted per our privacy policy.

14. Governing law and disputes

These terms are governed by the laws of Portugal. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

For EU consumers: you retain any mandatory consumer protection rights under the laws of your country of residence. Nothing in these terms limits those rights.

15. Changes to these terms

We may update these terms to reflect changes in our Service or legal requirements. Material changes will be announced on our website at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
